Terms of Service

01Agreement to these Terms

These Terms of Service (the “Terms”) form a binding agreement between you and Houcine Bousfiha (“Neem”, “we”, “us”), of Casablanca 20000, Morocco. They govern your access to and use of the Neem mobile application, its features and content, and any related services we provide (together, the “Service”).

By creating an account or using the Service, you confirm that you have read and agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

02The Service

Neem is an AI skincare simulator. It lets you choose a synthetic AI face model, describe your skin, scan a skincare product, and see an AI-generated preview of how the skin of that face model could look after using the product for 0, 30, 60 and 90 days. The Service also provides a skin profile, an analysis of the product and its relevance to your concerns, short timeline summaries, routines with optional reminders, a history of your saved simulations and, with Neem Plus, the Neem Assistant, an AI assistant that answers skincare questions using your Neem data and can carry out some actions for you once you confirm them, a side-by-side comparison of two of your simulations, detailed insights explaining each simulation’s timeline concern by concern, and the Skincare Report, a PDF of your Neem records that you can save or share.

Neem does not use or accept photos of your own face. It does not sell products, and it is not affiliated with the brands whose products you scan.

03Not medical advice

Neem is not a medical device and does not provide medical advice, diagnosis or treatment. Simulations, skin profiles, product analyses, relevance scores, routines, the Neem Assistant’s answers, Skincare Reports and all other content are cosmetic, illustrative and for general information only. They are not a prediction or promise of the results you will get: real results depend on many factors and vary from person to person.

Always read a product’s label and follow its directions and warnings. Consider a patch test before using a new product. If you have a skin condition, an allergy, are pregnant or breastfeeding, or are concerned about your skin, consult a dermatologist or other qualified healthcare professional. Never disregard or delay professional advice because of something you saw in Neem. If you experience an adverse reaction to a product, stop using it and seek medical attention.

Before your first simulation, the app asks you to confirm that you understand this.

04Eligibility

You must be at least 16 years old, and old enough to form a binding contract where you live, to use the Service. If you are under the age of majority in your country, you may use Neem only with the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf. You may not use the Service if you are barred from doing so under applicable law. When you create an account, you confirm that you meet this age requirement.

05Your account

You need an account to use the Service. You can create one with an email address and password, with Sign in with Apple, or with your Google account. You agree to provide accurate information, to keep your credentials confidential, and to tell us promptly at neemai.app@gmail.com if you suspect unauthorized use of your account. You are responsible for all activity that takes place under your account.

Your account is personal to you. You may not share it, sell it or transfer it to anyone else. You can delete your account at any time in the app (see Suspension, termination and deletion).

06Free simulation and Neem Plus

Free simulation

New accounts may receive one free simulation credit. The free credit is limited to one per person: it is not granted if an email address verified on your account has already received one, including on an account that has since been deleted. The free simulation includes the Day 0 and Day 90 images; Day 30 and Day 60 are part of Neem Plus. A credit is used only when your free simulation is completed and saved; if a simulation fails, the credit is not consumed. Free credits have no cash value and cannot be transferred.

Neem Plus subscriptions

Neem Plus is an optional paid subscription, offered on a monthly or yearly basis. It includes the full Day 0, 30, 60 and 90 timeline with its detailed insights, up to 5 new simulations in any 24 hours (see Fair use below), the ability to create a new skin profile at any time, the Neem Assistant, comparing two of your simulations side by side, and the Skincare Report (including the report of a single simulation). Every simulation you make is saved to your history, with or without Neem Plus. The features included may change over time; we will not materially reduce the core features of a subscription period you have already paid for.

• Purchase and billing. Subscriptions are purchased and billed through the Apple App Store or Google Play (the “Store”), using the payment method in your Store account. The price, currency and billing period are shown before you confirm the purchase, and taxes may apply.
• Automatic renewal. Your subscription renews automatically at the end of each period, at the then-current price, unless you cancel it at least 24 hours before the end of the current period. Your Store account is charged for renewal within 24 hours before the period ends.
• Cancellation. You can cancel at any time in your Store account settings. Cancellation takes effect at the end of the current paid period, and you keep access to Neem Plus until then. Deleting the Neem app or your Neem account does not cancel your subscription.
• Refunds. Payments are processed by the Store, and refund requests are handled by Apple or Google under their refund policies. Except where required by law, we do not provide refunds or credits for partial subscription periods. Nothing in these Terms limits any statutory right you may have, including any right of withdrawal under the consumer laws of your country.
• Price changes. We may change subscription prices. Any change will apply from your next renewal, and you will be notified in advance as required by the Store and applicable law.
• Restoring purchases. If you reinstall the app or change device, you can restore an active subscription from the app using the same Store account.

Fair use

To keep the Service available and sustainable for everyone, Neem Plus includes up to 5 new simulations in any rolling 24-hour period: each simulation counts from the moment it starts and frees up its place 24 hours later. A simulation that fails does not count, and completing the locked days of your free simulation is not a new simulation. The app shows how many simulations you have left and when the next one becomes available. Other reasonable limits also apply: one simulation in progress at a time, a maximum number of image generations per simulation, and a maximum number of messages to the Neem Assistant per day. We may adjust these limits to protect the Service, and we will not set them in a way that prevents normal personal use of Neem Plus.

07Acceptable use

You agree not to, and not to help anyone else to:

1. use the Service for any unlawful, harmful, fraudulent or misleading purpose;
2. upload photos of people, faces, identity documents or anything other than the skincare product you want to analyze, or any content that is illegal, infringing, offensive or that you do not have the right to share;
3. present simulations or other output as real before-and-after results, as medical evidence, or as an endorsement by Neem or by any brand, including in advertising;
4. create multiple accounts or use other means to obtain more than one free simulation, or to bypass usage limits or payments;
5. try to make the Neem Assistant ignore its rules or limits, reveal its instructions, or produce content unrelated to skincare and your use of Neem;
6. access the Service through automated means (bots, scrapers, scripts) or through any interface other than the app, or interfere with, overload or disrupt the Service or its infrastructure;
7. probe, scan or test the vulnerability of the Service, or bypass any security, authentication or access control measure;
8. copy, modify, reverse engineer, decompile or attempt to extract the source code, models or prompts of the Service, except to the extent the law expressly permits this despite this restriction;
9. use the Service or its output to develop or train a competing product or AI model; or resell, sublicense or commercially exploit the Service.

08Your content

“Your Content” means the skin descriptions, concern selections, product photos, routine information and messages to the Neem Assistant you submit to the Service. You retain all rights you hold in Your Content.

You grant Neem a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt and display Your Content, and to have our service providers do so on our behalf, solely to operate, provide, secure and improve the Service for you. This license ends when Your Content is deleted from our systems, including when you delete your account, except as described in our Privacy Policy. When a product is identified with high confidence, its brand, name and category (but never your photo or identity) may be added to a shared product catalog that helps the Service recognize that product for all users.

You represent that you have the rights needed to submit Your Content and that it does not violate these Terms or anyone’s rights. You are responsible for Your Content.

09AI-generated output

The Service uses artificial intelligence, including third-party models, to generate images, profiles, analyses, relevance scores, routines and text (“Output”). You acknowledge that:

• Output is illustrative. Simulated images show a synthetic face model, not you. They are generated from your description and the product information, and do not reproduce or predict the results of any real person or clinical study. To show a gradual change, Day 30 and Day 60 are usually composed from the Day 0 and Day 90 images, and a Day 0 image already made for the same face model and the same skin concerns may be reused.
• Output may be inaccurate. AI can misread a label, misidentify a product, or produce content that is incomplete, outdated or wrong. A “Verified” badge means only that the product was identified from its label with high confidence; it is not a certification or endorsement of the product.
• Routines are suggestions. Usage plans suggested by Neem are based on the label or, where no directions are readable, on the product’s type and ingredients. The product’s own label and a professional’s advice always take precedence.
• Output may vary. Similar inputs can produce different Output, and Output may be similar to Output generated for others.
• Report Output. If any Output seems wrong, unsafe, offensive or inappropriate, report it from where it appears: each simulation, timeline summary, skin profile, product analysis, relevance result and Neem Assistant reply has a report link. Reports go to the Neem team, who review them and may adjust or remove the Output and improve the Service.

Subject to these Terms, you may use Output generated for you for your own personal, non-commercial purposes. You are responsible for how you use Output, and you should independently evaluate it before relying on it.

10The Neem Assistant

The Neem Assistant is part of Neem Plus. It answers questions about skincare and about your use of Neem, using the information in your account, and declines unrelated topics. In addition to the section above on AI-generated output:

• General information only. The assistant does not diagnose, prescribe or replace a dermatologist or other healthcare professional, and it is not for emergencies. Its answers can be incomplete or wrong; check important information against the product’s label and with a professional.
• Actions you confirm. The assistant can offer to start a simulation, pause or resume a routine, or mark a task as done. Nothing happens until you confirm it on its card, and you are responsible for checking an action before confirming it. A simulation started this way follows the same rules as any other, including Neem Plus and the fair-use limits, and appears in your history. Offers you don’t confirm expire.
• Voice input. You can speak your message instead of typing it, and the description of your skin in the same way. Your device’s speech recognition turns it into text, which may contain mistakes: it lands in the field so you can check it before sending it or continuing.
• Reports. If you ask for one, the assistant can show a Skincare Report card; the report is made as described in The Skincare Report when you tap it.
• Your conversations. You can save a conversation, view your saved conversations, and clear or remove them at any time from the assistant’s menu. How we keep and delete them is described in our Privacy Policy.
• Availability. The assistant relies on third-party AI services and may occasionally be slow or unavailable. It is subject to the fair-use limits above, and we may change how it works as we improve it.

11The Skincare Report

The Skincare Report is part of Neem Plus. It puts the records in your account into a PDF: your skin profile, the products you scanned and what was read from their labels, your current routine, a timeline of your recorded activity, your saved simulations and counts of your activity, for all your history or the last 7, 30 or 90 days. You can also create the report of a single saved simulation: that simulation, the product it was made with and that product’s routine.

• Personal record-keeping. A report is for your information and personal tracking. It is not a medical record, a diagnosis or a substitute for professional advice, and the simulations in it are AI-generated illustrations on a face model, not photographs of your skin or a promise of results, as the report itself says.
• As recorded. A report shows what your account holds when you create it. It does not show what isn’t recorded: for example, a scanned product isn’t necessarily one you bought or used, and a reminder doesn’t mean a step was done.
• Your copy. The PDF is made on your device and we don’t keep it. Once you save or share it, keeping it safe is up to you, and you are responsible for whom you share it with. You may use it for your own personal, non-commercial purposes, including sharing it with a healthcare professional.

12Notifications

If you allow notifications, Neem may send you routine reminders at the times you choose and a notification when a simulation you asked to be told about is ready. You can turn reminders off in the app or disable notifications in your device settings at any time. Reminders are a convenience: we do not guarantee their delivery or timing.

13Our intellectual property

The Service, including its software, design, face models, illustrations, text, trademarks and logos, and all related intellectual property rights, are owned by Neem or its licensors. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to download and use the app on devices you own or control, for your personal, non-commercial use.

If you send us feedback or suggestions, we may use them freely without any obligation to you.

14Third-party brands and products

Product names, brand names and logos shown in the Service are the trademarks of their respective owners and are used only to identify the products you scan. Their display does not imply any affiliation with, sponsorship by or endorsement of Neem by those owners, or of those products by Neem. We are not responsible for third-party products, their labels, claims or effects.

15Third-party services

The Service relies on third-party services, including Apple and Google for sign-in, app distribution and payments, and providers for hosting, AI processing, image storage and notifications (listed in our Privacy Policy). Your use of Sign in with Apple, Google sign-in, the App Store and Google Play is also subject to those providers’ own terms and policies. We are not responsible for third-party services we do not control.

16Apple and Google

If you downloaded the app from the Apple App Store, you and we also agree that:

1. these Terms are between you and Neem only, not Apple, and Neem, not Apple, is solely responsible for the app and its content;
2. your license to use the app is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions;
3. Apple has no obligation to provide any maintenance or support services for the app;
4. if the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app;
5. Neem, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws;
6. in the event of any third-party claim that the app or your possession and use of it infringes that third party’s intellectual property rights, Neem, not Apple, is responsible for the investigation, defense, settlement and discharge of that claim;
7. you represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties;
8. you must comply with applicable third-party terms of agreement when using the app; and
9. Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

If you downloaded the app from Google Play, your use is also subject to the Google Play Terms of Service.

17Suspension, termination and deletion

By you. You may stop using the Service at any time and delete your account from the app (Profile → Delete account). Deletion is permanent: your account, skin profiles, scans, simulations, routines, assistant conversations and images are deleted as described in our Privacy Policy and cannot be recovered. If you signed in with Apple on iPhone, the app asks you to confirm with Apple so that Neem’s “Sign in with Apple” access is revoked too. Remember to cancel any subscription in your Store account separately.

By us. We may suspend or terminate your access to the Service, or withhold a free credit, if you materially or repeatedly breach these Terms, if your use creates a risk or legal exposure for Neem, other users or third parties, or if required by law. Where reasonable, we will tell you in advance and give you an opportunity to remedy the issue. We may also discontinue the Service, in whole or in part; if we discontinue it entirely, we will give you reasonable notice and, where applicable, information on how to obtain a pro-rata refund of prepaid subscription fees through the Store.

Sections that by their nature should survive termination, including Your Content (as to rights already exercised), AI-generated output, our intellectual property, disclaimers, limitation of liability, indemnification and governing law, will survive.

18Disclaimers

To the maximum extent permitted by law, the Service and all Output are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation. We do not warrant that any simulation, analysis or suggestion will be accurate, or that any product will produce any result. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

19Limitation of liability

To the maximum extent permitted by law, Neem and its affiliates, officers, employees, agents and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the Service or these Terms, even if advised of the possibility of such damages. Our total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid us for the Service in the twelve months before the event giving rise to the claim, and (b) USD 50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or, if you are a consumer in the EEA or the UK, your statutory rights.

20Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Neem and its affiliates, officers and employees from any claims, damages, losses and expenses (including reasonable legal fees) arising from Your Content, your misuse of the Service or of Output, or your breach of these Terms or of applicable law. This section does not apply to consumers where such an obligation is not permitted by law.

21Governing law and disputes

These Terms are governed by the laws of Morocco, without regard to its conflict of laws rules. Subject to the paragraph below, the courts of Casablanca, Morocco have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in the courts of that country. Before starting proceedings, we encourage you to contact us at neemai.app@gmail.com so we can try to resolve the issue informally. Consumers in the EU may also use the alternative dispute resolution bodies available in their country.

22Changes to the Service and these Terms

We continually improve Neem and may add, change or remove features. Some updates are delivered to the app automatically; when an older version of the app can no longer work with the Service, the app asks you to install the latest version from your app store before you can continue. We may update these Terms from time to time, for example to reflect changes to the Service or the law. We will post the updated Terms here with a new “Last updated” date and, for material changes, notify you in the app or by email at least 30 days before they take effect. If you continue to use the Service after the changes take effect, you accept the updated Terms; if you do not agree, you may stop using the Service and delete your account.

23General

These Terms, together with the Privacy Policy, are the entire agreement between you and Neem regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets, provided your rights are not reduced. Neither party is liable for delays caused by events beyond its reasonable control. These Terms are written in English; if we provide a translation, the English version prevails to the extent permitted by law.
